GENERAL TERMS AND CONDITIONS OF BUSINESS
stayVision (indiVision Immobilien GmbH, Buschgasse 55, 50321 Brühl)
§ 1 Scope and provider
(1) The General Terms and Conditions (hereinafter referred to as “GTC”) govern the contractual relationship between indiVision Immobilien GmbH (hereinafter referred to as “Host” or “stayVision”) and you (hereinafter referred to as “Guest”), in the version valid at the time of conclusion of the contract.
(2) Any deviating terms and conditions of the guest will be rejected. Please read these terms and conditions carefully before using any of stayVision's services.
(3) The subletting or further rental of the holiday apartment provided as well as its use for purposes other than residential purposes require the prior written consent of stayVision and are otherwise prohibited.
§ 2 Conclusion of the contract
Booking requests are generally non-binding until the booking has been confirmed by stayVision. Exceptions apply only if you book through a booking portal. In this case, the terms and conditions governing the booking process apply.
§ 3 Description of the scope of services
(1) The scope of services provided by stayVision consists of the following: short-term rental of furnished apartments for accommodation.
(2) Any other use is prohibited or requires the prior written consent of stayVision. A general prohibition applies in particular to gatherings, parties, subletting, use for prostitution, etc.
§ 4 Terms of payment
(1) The booking price must be paid in full prior to arrival. If payment is not received or is incomplete, stayVision reserves the right to deny access to the apartment.
(2) You agree to receive invoices electronically. Electronic invoices will be made available to you via email or in your customer account on the website.
(3) If payment deadlines are not met, stayVision may withdraw from the contract.
(4) Should stayVision offer payment by credit card or direct debit and the guest chooses this payment method, the guest expressly authorizes stayVision to collect the amounts due. Any costs for chargebacks due to insufficient funds or incorrect information are borne by the guest.
(5) The chosen payment method may also be used to charge deposits or claims for damages.
(6) In case of late payment, stayVision reserves the right to claim damages caused by the delay.
§ 5 Arrival and departure
(1) The apartment is available from 3 p.m. on the day of arrival. Check-in information is usually provided one day in advance.
(2) Claims for damages due to delayed receipt are excluded.
(3) Departure must be by 11 a.m. Later departures are only possible by arrangement and may incur an additional charge.
(4) No refund will be given for early departure.
(5) The apartment must be left in a clean and tidy condition. Uncleaned dishes, garbage, etc. will be charged.
§ 6 Holiday apartment
(1) The apartment will be handed over clean and complete. Any defects must be reported immediately.
(2) The guest is liable for any damage, including lost keys.
(3) Inventory must be treated with care and must not be removed or disturbed.
(4) The apartment must be kept clean during your stay. Failure to comply will result in additional cleaning costs of at least €100 plus VAT.
(5) In case of breach of contract (e.g. subletting, disturbance), termination without notice is possible.
§ 7 Pets
Pets are allowed only with prior written consent. Without consent, a cleaning fee of up to €200 plus VAT may be charged.
§ 8 Stay
The apartment may only be used by the registered occupants. The check-in form must be submitted on time. Failure to comply will result in immediate termination of the contract. No refunds are available for violations of these rules.
§ 9 Cancellation of travel
Cancellations up to 14 days before arrival: 5% processing fee. After that, no refunds. The host may cancel the booking in cases of force majeure, etc. Refunds will be made via the original payment method, possibly via Stripe.
§ 10 Liability of the host
Liability is assumed only for the proper provision of the apartment. No liability for breakdowns or force majeure.
§ 11 Use of WLAN
(1) Wi-Fi may be shared.
(2) No warranty as to functionality. Unlawful use is prohibited.
(3) Pages can be blocked by stayVision (e.g. violence, pornography).
§ 12 House rules, rights and obligations
(1) House rules are binding and can be viewed on the website.
(2) Check-out time is binding. If exceeded: €30 per hour plus VAT.
(3) Smoking is prohibited in the apartment. Violation: €250 plus VAT.
(4) Keep the apartment clean, otherwise at least 100 € plus VAT cleaning costs.
(5) Night rest from 10pm to 7am.
(6) Close windows and doors when leaving.
(7) Decoration or similar only with consent.
(8) Right of access in case of imminent danger.
§ 13 Data Protection
(1) Data is only collected with consent.
(2) Data transmission over the Internet can be insecure.
(3) Contact details may be used for subsequent advertising.
(4) The right to information about stored data exists at any time.
(5) Right to erasure, rectification, restriction of processing.

§ 14 Cookies
(1) Cookies may be used.
(2) Cookie IDs are used for recognition purposes.
(3) Cookies improve user experience.
(4) Session cookies and persistent cookies possible.
(5) Objection possible via cookie banner.
(6) Browser can be customized for cookie management.
§ 15 Place of jurisdiction and applicable law
(1) German law applies. The UN Convention on Contracts for the International Sale of Goods is excluded.
(2) The place of jurisdiction is Brühl, if legally permissible.
§ 16 Final provisions
(1) The contract language is German.
(2) Waiver of rights in the event of a violation by toleration is excluded.
(3) Invalid clauses shall be replaced by valid ones that come closest to the intended purpose.
